Welcome to Auction11. These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Auction11 ("Company", "we", "us", or "our"), governing your access to and use of our platform and digital services available at https://www.auction11.live.

  • Deleting, altering, or obscuring proprietary notices or labels on Content.
  • Harassing, threatening, or intimidating other users or our personnel.
  • Accessing the Services for competitive intelligence or commercial exploitation without consent.
  • Using the Services in violation of any applicable Indian or international law or regulation.
  • Circumventing or attempting to bypass any technical restrictions or access controls.

Any violation of these prohibitions may result in immediate termination of your access and may expose you to legal liability.

5. User-Generated Contributions

To the extent that our platform permits you to submit, post, or share content ("Contributions"), you are solely responsible for all Contributions you make. While we retain the right to monitor, edit, or remove Contributions at our discretion, we do not assume any liability for user-submitted content.

You retain ownership of your Contributions but grant Auction11 a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, and display such Contributions in connection with the operation of our Services.

6. Contribution Licence

By submitting feedback, reviews, or suggestions regarding the Services, you grant us the right to use and share such input without restriction or compensation. We do not assert ownership over your Contributions beyond the licence described herein and are not liable for any representations made within them.

7. Services Management

Auction11 reserves the right, at its sole discretion, to:

  1. Monitor the platform for violations of these Terms.
  2. Take appropriate legal action against users who violate applicable laws or these Terms.
  3. Restrict or limit access to any portion of the Services.
  4. Remove content that is excessive, harmful, or in breach of these Terms.
  5. Manage the platform in a manner that protects our interests and ensures proper operation.

8. Term and Termination

These Terms remain in effect for as long as you use the Services. We reserve the right, in our sole discretion and without notice or liability, to:

  • Deny or restrict access to any user for any reason.
  • Terminate or suspend any account at any time.

If your account is suspended or terminated, you are prohibited from re-registering under any name without our prior written consent. We reserve the right to pursue all legal remedies available to us for violations of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. The courts of competent jurisdiction located in Belagavi, Karnataka, India shall have exclusive jurisdiction to adjudicate any disputes arising from or related to these Terms or your use of the Services.

11. Dispute Resolution

11.1 Informal Negotiation

Before initiating any formal legal proceedings, the parties agree to attempt to resolve any dispute, claim, or controversy arising from these Terms ("Dispute") through good-faith informal negotiations for a minimum period of 45 (forty-five) days from the date written notice is served by one party to the other.

11.2 Restrictions on Arbitration

Any dispute resolution proceedings shall be conducted individually and not as part of a class or consolidated action. No arbitration may be joined with any other proceeding, and neither party may bring claims in a representative capacity on behalf of the public.

11.3 Exceptions

The following Disputes are not subject to informal negotiation or arbitration and shall be resolved by courts of competent jurisdiction:

  • Disputes concerning the enforcement, validity, or protection of intellectual property rights.
  • Claims arising from theft, piracy, privacy violations, or unauthorised use.
  • Claims for injunctive or equitable relief.

12. Corrections

We reserve the right to correct any typographical errors, inaccuracies, or omissions in the content of our Services at any time and without prior notice. This includes corrections to descriptions, pricing, availability, and any other information displayed on the platform.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AUCTION11 DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) THE INFORMATION PROVIDED IS ACCURATE, COMPLETE, OR CURRENT; OR (C) DEFECTS, IF ANY, WILL BE CORRECTED. YOUR USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUCTION11 AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF — OR INABILITY TO USE — THE SERVICES, INCLUDING LOSS OF DATA, REVENUE, OR PROFIT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY TO YOU FOR ANY CAUSE OF ACTION SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless Auction11 and its officers, employees, agents, and partners from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from:

  1. Your use of the Services.
  2. Your breach of these Terms.
  3. Your violation of any third-party rights, including intellectual property rights.
  4. Any harmful or unlawful act committed by you in connection with the Services.

We reserve the right to assume exclusive control of any matter subject to indemnification by you, and you agree to cooperate with our defence at your expense.

16. User Data

We collect and maintain certain data transmitted through the Services for operational and performance purposes. You are solely responsible for the accuracy and legality of data you submit. If any provision of these Terms is found to be unlawful or unenforceable, it shall be severed from the remaining provisions, which will continue in full force and effect. Our failure to enforce any provision does not constitute a waiver of our right to do so in the future.

We may assign our rights and obligations under these Terms at any time. You may not assign your rights without our prior written consent.
